Grounds for Contesting a Will in New York

A will contest challenges the legal validity of a will submitted for probate. New York law recognizes several grounds on which an interested party can file objections.

• Lack of testamentary capacity: The testator must have understood they were making a will, understood the nature and extent of their property, and recognized the people who would ordinarily inherit from them. A diagnosis alone doesn’t establish incapacity, but a pattern of cognitive decline close to the time of signing can support a challenge.
• Undue influence: Another person exerted pressure that overcame the testator’s free will, causing them to make a will they wouldn’t otherwise have made. This often involves a caregiver, a family member in a position of trust, or someone who isolated the testator from others.
• Fraud or forgery: The testator was deceived into signing a document, or the signature or contents were falsified.
